Buyer Agency vs Sub-Agency

Confidentiality: The pivot between client and customer.

Agency determines who the agent represents. For sellers, the structure is straightforward. They have a listing contract and the listing agent works for the seller. For buyers, there are two possible relationships. The difference is not always obvious in practice, but it is important because it defines to whom the agent owes loyalty and especially confidentiality during the transaction.

In a nutshell, if you are the buyer, a Buyer’s Agent works for you and you are their client. Agents owe loyalty and confidentiality to their clients.

A Sub‑Agent is a type of Seller’s Agent, so by definition they work for and owe their loyalty and confidentiality to the Seller. If you are the buyer, you are the Sub‑Agent’s customer rather than his client.

Both are legitimate forms of agency but both types of agent have an obligation to treat their clients and their customers fairly and honestly.

 

Seller Agency

A seller has one avenue: a listing contract. This is the process of the seller hiring an agent to represent them.

The listing agent works for the seller and owes the seller loyalty, confidentiality, and full advocacy. The listing agent markets the property, manages showings, handles negotiations, and represents the seller’s interests throughout the transaction.

Buyer Agency

A buyer can secure direct representation by hiring a buyer’s agent. In this relationship, the agent represents the buyer.

The buyer’s agent works for the buyer and owes the buyer loyalty, confidentiality, and full advocacy. A buyer’s agent evaluates properties, points out issues, explains contract clauses, manages documents, coordinates inspections, and negotiates terms that fit the buyer’s objectives. The buyer’s agent protects the buyer’s leverage and confidentiality throughout the process.

Buyer agency is created by signing a buyer agency agreement. That agreement also establishes how the commission is handled within the offer. The fee is consistent. The question is: how the parties choose to allocate it.

Sub-agency (Cooperating Agent Working for the Listing Firm)

A buyer can also work with “their” agent as a cooperating or sub-agent of the listing firm. In this situation, the agent assisting the buyer is actually working for the seller.

A sub-agent works for the seller and owes the seller loyalty and confidentiality. A sub-agent can show the property and answer factual questions, but cannot advocate for the buyer, negotiate for the buyer, or put the buyer’s interests ahead of the seller’s. A sub-agent cannot advise on strategy, leverage, negotiation, or point out issues that would weaken the seller’s position. The role is to help facilitate the sale while protecting the seller’s interests.

Sub-agency is not buyer representation. It is seller representation with limited assistance to the buyer.

The Difference in One Sentence

Buyer agency means the agent works for the buyer. Sub-agency means the agent works for the seller.

Simple but important.

Which One Should You Choose?

Most buyers want representation. They want someone who works for them, negotiates for them, and manages the transaction on their behalf. Some buyers choose sub-agency when they prefer to handle their own evaluation and negotiation. The choice belongs to the buyer, and the relationship is defined in writing so everyone understands who is being represented.
